Welcome to Everytime Learning. By downloading, installing, or using the Everytime Learning mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Description of Service

Everytime Learning is a language learning application that delivers personalized sentences, vocabulary, and learning content through notifications and an interactive interface. The App uses artificial intelligence to generate learning materials, provide chat-based language assistance, and create visual content.

2. Account Registration

To use the App, you must create an account by signing in with a supported authentication provider (Google, Apple, or Facebook). You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

3. Free and Pro Tiers

3.1 Free Tier

The free tier provides access to core learning features with certain usage limits, including restrictions on the number of target languages, daily AI interactions, dictionary lookups, and custom themes. The free tier may include advertisements.

3.2 Pro Tier

The Pro subscription unlocks expanded limits and additional features. Pro subscriptions are billed through the Apple App Store or Google Play Store and are subject to the respective store's subscription terms.

3.3 Pricing

Subscription prices are determined by the Apple App Store and Google Play Store, including any applicable regional pricing and taxes. Prices may vary by region and are displayed in your local currency at the time of purchase.

3.4 Cancellation and Refunds

You may cancel your Pro subscription at any time through your device's app store settings. Upon cancellation, you will retain Pro access until the end of your current billing period. Refunds are handled by Apple or Google in accordance with their refund policies.

The App uses artificial intelligence (Google Gemini and other models) to generate sentences, translations, definitions, and conversational responses. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or cultural nuances that are imperfect.

The App is a supplementary learning aid. AI-generated translations, explanations, and examples should not be relied upon for critical, professional, legal, medical, or safety-related communications. You should always verify important translations with a qualified human translator or authoritative source.

6. Intellectual Property

The App, including its design, code, features, and branding, is the intellectual property of Everytime Learning. System-generated content (sentences, Word of the Day imagery) is provided for your personal, non-commercial learning use. You may not redistribute, sell, or repurpose App-generated content for commercial purposes.

7. User Content

You retain ownership of any content you create within the App, such as custom themes. By creating content in the App, you grant us a limited license to store and display that content as necessary to provide the service.

8. Service Availability

We strive to keep the App available at all times but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any feature of the App at any time.

To the maximum extent permitted by law, Everytime Learning shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be error-free, that AI-generated content will be accurate, or that the service will meet your specific requirements.

12. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website or within the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
